Introductory materials
Article 1
Commercial companies of any kind are subject to commercial law and custom.
Article 2
With the exception of a joint venture, all commercial companies have legal personality.
Article 3
In all commercial companies, the claims of the creditors of the company shall be prescribed to the partners five years after the dissolution of the company, or to the exit of one of the partners in respect of the claims against this partner. The period of limitation shall apply from the day of completion of the month in all cases in which the month is due, and from the day of closure of liquidation in cases arising out of liquidation itself.

الشركات التجارية، أيا كان نوعها، تخضع للقانون والعرف التجاري.

فيما عدا شركة المحاصة، تتمتع جميع الشركات التجارية بالشخصية المعنوية.
المادة رقم 3
في جميع الشركات التجارية، تسقط بالتقادم دعاوى دائني الشركة على الشركاء بعد انقضاء خمس سنوات على انحلال الشركة، أو على خروج أحد الشركاء فيما يختص بالدعاوى الموجهة إلى هذا الشريك. وتسري مدة التقادم من يوم اتمام الشهر في جميع الحالات التي يكون الشهر فيها واجبا، ومن يوم إغلاق التصفية في الدعاوى الناشئة عن التصفية نفسها.
