General definitions
Article 1
In the application of the provisions of this law, the following terms and words shall have the meanings assigned to each of them:
1. Municipal: The Municipal Council and the executive body of the municipality.
2. The Minister: The Minister concerned with municipal affairs.
3. Chairman of the Council: Chairman of the Municipal Council.
4. Director General: Chairman of the Executive Body.
5. General Secretariat: The General Secretariat of the Municipal Council.
6. Secretary General: Secretary General of the Municipal Council.
7. The Executive Body: All administrative, financial, engineering, and service units, and development and research units outside the units of the General Secretariat of the Municipal Council.
8. General Structure of the State: The general framework that defines the future objectives and urban policies that reflect the vision, objectives and plans of the State’s political, economic, social and environmental land uses during a specified period.
9. Structural plans for the regions, cities and suburbs: These are the organizational and survey plans for the distribution of different land uses, facilities and services within the boundaries of the same area in accordance with the general structural plan of the State.
Article 2
The Municipality of Kuwait is an independent public body, headquartered in Kuwait City, consisting of the Municipal Council and the executive body of the municipality.
The municipality shall have a supplementary budget, which shall be annexed to the budget of the ministries and government departments including its revenues and expenses.
The municipality’s financial resources shall consist of the appropriations allocated to it in the general budget of the State annually, and any other revenues not inconsistent with the provisions of this law.
Article 3
The municipality shall formulate, implement and develop the urban policy, highlight the Kuwaiti character, preserve and develop the architectural heritage in a manner consistent with the civilization character of the country in accordance with the general structural plan of the State. It shall also provide municipal services to the population, in particular surveying the lands, organizing cities, suburbs, regions and islands. Approving its structural plans and maintaining the general population comfort and cleanliness in accordance with the competencies prescribed for it in this regard.
Subject to the provisions of Digital Law 33 for the year 2000 and 39 for the year 2002 referred to, the Municipality shall undertake the works stipulated in Article 3 of the Real Estate Registration Law to inspect, survey, identify and draw drawings and confirm the calculation of their surfaces, provided that the boundaries of these properties shall not exceed those stipulated in their official documents. Its plans shall not be amended or altered except with the consent of the concerned parties or upon final judicial decisions, except for State-owned lands.

تعريفات عامة
مادة 1
في تطبيق أحكام هذا القانون يقصد بالعبارات والكلمات التالية المعنى الموضع قرين كل منها:
1 ـ البلدية: المجلس البلدي والجهاز التنفيذي للبلدية.
2 ـ الوزير: الوزير المختص بشؤون البلدية.
3 ـ رئيس المجلس: رئيس المجلس البلدي.
4 ـ المدير العام: رئيس الجهاز التنفيذي.
5 ـ الأمانة العامة: الأمانة العامة للمجلس البلدي.
6 ـ الأمين العام: أمين عام المجلس البلدي.
7 ـ الجهاز التنفيذي: مجمل الوحدات الإدارية والمالية والهندسية والخدمية ووحدات التطوير والبحوث والخارجة عن نطاق وحدات الأمانة العامة للمجلس البلدي.
8 ـ المخطط الهيكلي العام للدولة: الإطار العام الذي يحدد الأهداف والسياسات العمرانية المستقبلية والتي تعكس رؤية وأهداف وخطط الدولة السياسية والاقتصادية والاجتماعية والبيئية على استعمالات الأراضي خلال فترة محددة.
9 ـ المخططات الهيكلية للمناطق والمدن والضواحي: هي المخططات التنظيمية والمساحية لتوزيع استعمالات الأراضي المختلفة والمرافق والخدمات ضمن حدود المنطقة الواحدة وبما يتوافق مع المخطط الهيكلي العام للدولة.
مادة 2
بلدية الكويت هيئة عامة مستقلة يكون مقرها مدينة الكويت، تتكون من المجلس البلدي والجهاز التنفيذي للبلدية، وتكون لها الشخصية الاعتبارية، وتخضع لإشراف الوزير.
ويكون للبلدية ميزانية ملحقة، تلحق بميزانية الوزارات والإدارات الحكومية شاملة لإيراداتها ومصروفاتها.
وتتكون الموارد المالية للبلدية من الاعتمادات المخصصة لها في الميزانية العامة للدولة سنويا، ومن اي ايرادات اخرى لا تتعارض وأحكام هذا القانون.
مادة 3
تعمل البلدية على رسم السياسة العمرانية وتنفيذها وتطويرها وإبراز الطابع الكويتي والمحافظة على التراث المعماري وإبرازه بصورة متطورة تتوافق مع الطابع الحضاري للبلاد وفقا للمخطط الهيكلي العام للدولة، كما تعمل على توفير الخدمات البلدية للسكان، وتتولى على وجه الخصوص مسح الاراضي وتنظيم المدن والضواحي والمناطق والجزر واقرار مخططاتها الهيكلية والمحافظة على الراحة والنظافة العامة السكانية وفقا للاختصاصات المقررة لها في هذا الشأن.
ومع مراعاة احكام قانوني رقمي 33 لسنة 2000 و39 لسنة 2002 المشار اليهما، تتولى البلدية الاعمال المنصوص عليها في المادة الثالثة من قانون التسجيل العقاري الخاصة بمعاينة العقارات ومسحها وتحديدها وعمل رسوماتها وتأكيد حساب مسطحاتها على ألا تجاوز حدود هذه العقارات ما هو منصوص عليه في وثائقها الرسمية، ولا تعدل او تبدل مخططاتها الا بموافقة اصحاب العلاقة او بناء على احكام قضائية نهائية ما عدا الاراضي المملوكة للدولة.
