Work on the private sector
Article 1
In the application of the provisions of this Law, the term “
- – Ministry: The Ministry of Social Affairs and Labor.
- – Minister: Minister of Social Affairs and Labor.
- – Worker: Any male or female who performs manual or mental work for the benefit of the employer and under his administration and supervision for a wage.
- – Employer: Any natural or legal person who employs paid workers.
- – Organization: Organizing all groups of workers or employers who are similar or related to their work, professions or jobs, sponsoring their interests, defending their rights and representing them in all matters related to their affairs.
Article 2
The provisions of this law shall apply to workers in the private sector.
Article 3
The provisions of this law shall apply to the maritime labor contract unless a provision is made in the Maritime Trade Law or the provision in this law is more beneficial to the worker.
Article 4
The provisions of this law shall apply to the oil sector unless a provision is made in the labor law in the oil business sector or the provision in this law is more useful to the worker.
Article 5
The application of the provisions of this Law shall be exempted from:
- – Workers subject to other laws as stipulated in these laws.
- – Domestic workers. The Minister concerned shall issue a decision on the rules governing the relationship between them and employers.
Article 6
Without prejudice to any better privileges or rights established for workers in individual or collective employment contracts, special regulations or regulations applicable to the employer, or according to the profession or general custom, the provisions of this law shall be deemed the minimum.

ﻓﻲ ﺷﺄﻥ اﻟﻌﻤﻞ ﺑﺎﻟﻘﻄﺎﻉ اﻷﻫﻠﻲ
اﻟﻤﺎﺩﺓ ﺭﻗﻢ 1
ﻓﻲ ﺗﻄﺒﻴﻖ ﺃﺣﻜﺎﻡ ﻫﺬا اﻟﻘﺎﻧﻮﻥ ﻳﻘﺼﺪ ﺑﺎﺻﻄﻼﺡ:
- – اﻟﻮﺯاﺭﺓ: ﻭﺯاﺭﺓ اﻟﺸﺆﻭﻥ اﻻﺟﺘﻤﺎﻋﻴﺔ ﻭاﻟﻌﻤﻞ.
- – اﻟﻮﺯﻳﺮ: ﻭﺯﻳﺮ اﻟﺸﺆﻭﻥ اﻻﺟﺘﻤﺎﻋﻴﺔ ﻭاﻟﻌﻤﻞ.
- – اﻟﻌﺎﻣﻞ: ﻛﻞ ﺫﻛﺮ ﺃﻭ ﺃﻧﺜﻰ ﻳﺆﺩﻱ ﻋﻤﻼ ﻳﺪﻭﻳﺎ ﺃﻭ ﺫﻫﻨﻴﺎ ﻟﻤﺼﻠﺤﺔ ﺻﺎﺣﺐ اﻟﻌﻤﻞ ﻭﺗﺤﺖ ﺇﺩاﺭﺗﻪ ﻭﺇﺷﺮاﻓﻪ ﻣﻘﺎﺑﻞ ﺃﺟﺮ.
- – ﺻﺎﺣﺐ اﻟﻌﻤﻞ: ﻛﻞ ﺷﺨﺺ ﻃﺒﻴﻌﻲ ﺃﻭ اﻋﺘﺒﺎﺭﻱ ﻳﺴﺘﺨﺪﻡ ﻋﻤﺎﻻ ﻣﻘﺎﺑﻞ ﺃﺟﺮ.
- – اﻟﻤﻨﻈﻤﺔ: ﺗﻨﻈﻴﻢ ﺟﻤﻴﻊ ﻣﺠﻤﻮﻋﺔ ﻣﻦ اﻟﻌﻤﺎﻝ ﺃﻭ ﺃﺻﺤﺎﺏ اﻷﻋﻤﺎﻝ ﺗﺘﺸﺎﺑﻪ ﺃﻭ ﺗﺮﺗﺒﻂ ﺃﻋﻤﺎﻟﻬﻢ ﺃﻭ ﻣﻬﻨﻬﻢ ﺃﻭ ﻭﻇﺎﺋﻔﻬﻢ ﻭﻳﺮﻋﻰ ﻣﺼﺎﻟﺤﻬﻢ، ﻭﻳﺪاﻓﻊ ﻋﻦ ﺣﻘﻮﻗﻬﻢ ﻭﺗﻤﺜﻴﻠﻬﻢ ﻓﻲ ﻛﺎﻓﺔ اﻷﻣﻮﺭ اﻟﻤﺘﻌﻠﻘﺔ ﺑﺸﺆﻭﻧﻬﻢ.
اﻟﻤﺎﺩﺓ ﺭﻗﻢ 2
ﺗﺴﺮﻱ ﺃﺣﻜﺎﻡ ﻫﺬا اﻟﻘﺎﻧﻮﻥ ﻋﻠﻰ اﻟﻌﺎﻣﻠﻴﻦ ﻓﻲ اﻟﻘﻄﺎﻉ اﻷﻫﻠﻲ.
اﻟﻤﺎﺩﺓ ﺭﻗﻢ 3
ﺗﺴﺮﻱ ﺃﺣﻜﺎﻡ ﻫﺬا اﻟﻘﺎﻧﻮﻥ ﻋﻠﻰ ﻋﻘﺪ اﻟﻌﻤﻞ اﻟﺒﺤﺮﻱ ﻓﻴﻤﺎ ﻟﻢ ﻳﺮﺩ ﺑﺸﺄﻧﻪ ﻧﺺ ﻓﻲ ﻗﺎﻧﻮﻥ اﻟﺘﺠﺎﺭﺓ اﻟﺒﺤﺮﻳﺔ ﺃﻭ ﻳﻜﻮﻥ اﻟﻨﺺ ﻓﻲ ﻫﺬا اﻟﻘﺎﻧﻮﻥ ﺃﻛﺜﺮ ﻓﺎﺋﺪﺓ ﻟﻠﻌﺎﻣﻞ.
اﻟﻤﺎﺩﺓ ﺭﻗﻢ 4
ﺗﺴﺮﻱ ﺃﺣﻜﺎﻡ ﻫﺬا اﻟﻘﺎﻧﻮﻥ ﻋﻠﻰ اﻟﻘﻄﺎﻉ اﻟﻨﻔﻄﻲ ﻓﻴﻤﺎ ﻟﻢ ﻳﺮﺩ ﺑﺸﺄﻧﻪ ﻧﺺ ﻓﻲ ﻗﺎﻧﻮﻥ اﻟﻌﻤﻞ ﻓﻲ ﻗﻄﺎﻉ اﻷﻋﻤﺎﻝ اﻟﻨﻔﻄﻴﺔ ﺃﻭ ﻳﻜﻮﻥ اﻟﻨﺺ ﻓﻲ ﻫﺬا اﻟﻘﺎﻧﻮﻥ ﺃﻛﺜﺮ ﻓﺎﺋﺪﺓ ﻟﻠﻌﺎﻣﻞ.
اﻟﻤﺎﺩﺓ ﺭﻗﻢ 5
ﻳﺴﺘﺜﻨﻰ ﻣﻦ ﺗﻄﺒﻴﻖ ﺃﺣﻜﺎﻡ ﻫﺬا اﻟﻘﺎﻧﻮﻥ:
- – اﻟﻌﻤﺎﻝ اﻟﺬﻳﻦ ﺗﺴﺮﻱ ﻋﻠﻴﻬﻢ ﻗﻮاﻧﻴﻦ ﺃﺧﺮﻯ ﻓﻴﻤﺎ ﻧﺼﺖ ﻋﻠﻴﻪ ﻫﺬﻩ اﻟﻘﻮاﻧﻴﻦ.
- – اﻟﻌﻤﺎﻟﺔ اﻟﻤﻨﺰﻟﻴﺔ ﻭﻳﺼﺪﺭ اﻟﻮﺯﻳﺮ اﻟﻤﺨﺘﺺ ﺑﺸﺆﻭﻧﻬﻢ ﻗﺮاﺭا ﺑﺎﻟﻘﻮاﻋﺪ اﻟﺘﻲ ﺗﻨﻈﻢ اﻟﻌﻼﻗﺔ ﺑﻴﻨﻬﻢ ﻭﺑﻴﻦ ﺃﺻﺤﺎﺏ اﻟﻌﻤﻞ.
اﻟﻤﺎﺩﺓ ﺭﻗﻢ 6
ﻣﻊ ﻋﺪﻡ اﻹﺧﻼﻝ ﺑﺄﻱ ﻣﺰاﻳﺎ ﺃﻭ ﺣﻘﻮﻕ ﺃﻓﻀﻞ ﺗﺘﻘﺮﺭ ﻟﻠﻌﻤﺎﻝ ﻓﻲ ﻋﻘﻮﺩ اﻟﻌﻤﻞ اﻟﻔﺮﺩﻳﺔ ﺃﻭ اﻟﺠﻤﺎﻋﻴﺔ ﺃﻭ اﻟﻨﻈﻢ اﻟﺨﺎﺻﺔ ﺃﻭ اﻟﻠﻮاﺋﺢ اﻟﻤﻌﻤﻮﻝ ﺑﻬﺎ ﻟﺪﻯ ﺻﺎﺣﺐ اﻟﻌﻤﻞ ﺃﻭ ﺣﺴﺐ ﻋﺮﻑ اﻟﻤﻬﻨﺔ ﺃﻭ اﻟﻌﺮﻑ اﻟﻌﺎﻡ، ﺗﻤﺜﻞ ﺃﺣﻜﺎﻡ ﻫﺬا اﻟﻘﺎﻧﻮﻥ اﻟﺤﺪ اﻷﺩﻧﻰ ﻟﺤﻘﻮﻕ اﻟﻌﻤﺎﻝ.
