The marriage takes place positively from the wife’s guardian and acceptance from the husband or his representative.
Article 9
(A) The affirmative and acceptance of marriage shall be verbally expressed in terms of custom or in any language. B – It may be positive between the absent in writing or by a messenger. C – when the inability to pronounce the place of writing, if it could not be understood by reference.

المادة رقم 8
ينعقد الزواج بإيجاب من ولي الزوجة وقبول من الزوج أو ممن يقوم مقامهما.
المادة رقم 9
أ- يكون الإيجاب والقبول في الزواج مشافهة بالألفاظ التي تفيد معناه عرفا أو بأي لغة. ب- ويجوز أن يكون الإيجاب بين الغائبين بالكتابة أو بواسطة رسول. جـ- وعند العجز عن النطق تقوم مقامة الكتابة، فإن تعذرت فبالإشارة المفهمة.
